sGENERAL CONDITIONS OF USE
Art. 1 (General Conditions)
1.1 The hereby stated general conditions of use, hereinafter referred to as general conditions regulate the mutual rights and duties between the Tourism Consortium Alta Badia as administrator of the online booking system on one side, and on the other side the internet user using the aforementioned system.
1.2 The online booking system is an electronic platform which serves as go-between between individual business establishment and the internet user, who both, once the contract has been defined, shall operate autonomously and independently from the Tourism Consortium Alta Badia.
1.3 The Tourism Consortium as administrator of the online booking system, therefore shall not take part in any instance in the contractual relationships between the individual business establishment and the client, even should this have arisen via means of the online booking system, and the present general conditions expressly exclude a regulation of the legal relationship which will arise between individual business establishment and the client.1.4 The contents and conditions of the booking contract (i.e. services, additional services, cancellation terms, possible fines should the client not show up) will be agreed upon only between the individual business establishment and the client, who themselves shall personally respond to possible breaches, as well as for any other contractual and extra-contractual responsibility.1.5 Confirmation of having read and the expressed acceptance of the present general conditions by the internet user is a binding condition to send the booking request via the online booking system. The internet user who does not accept the present conditions is not authorized to use the online booking system.Art.2 (Definitions)
2.1 “The online booking system“ of the Tourism Consortium Alta Badia is an automated information and booking system, which can be used on the website of the Tourism Consortium Alta Badia www.altabadia.org The Tourism Consortium offers the aforementioned system to both the individual business establishment and internet user with the aim of initiating business relationships between the individual business establishment and the client.
2.2 “Individual business establishment“ are natural and/or legal persons, companies or institutions which offer overnight stays, hotel services and other tourist services by using the online booking system
2.3 “Internet users“ are natural and/or legal persons, companies or institutions which use the online booking system administrated by the Tourism Consortium to gather information on the tourism services offered, with the objective of following up with a possible booking.
2.4 “Clients“ are natural and/or legal persons, companies or institutions who book overnight stays, hotel services and other tourism services by using the online booking system at the individual business establishments premises.
2.5 “Data content“ refers to different data and information regarding the offered tourism services, contents which have been inserted into the online booking system autonomously by the receptive business, irrespective of the form they take.
Art. 3 (Rights and obligations of the internet user)
3.1 The legal relationship regarding the effected bookings is exclusively between the individual business establishment and the client.
3.2 The information and data transmitted to the internet user on the online booking system are not provided or produced by the Tourism Consortium, but rather directly from the individual business establishment.
3.3 The individual business establishment commits itself to full transparency in the dealings, especially regarding insertion and protection of data. The prices inserted for the tourism services are “all-inclusive“ prices.
3.4 The individual business establishment commits itself to offering only available services to the client and is exclusively responsible for the offers inserted.
3.5 The individual business establishment commits itself to accepting and treating as binding offers those bookings received on the online booking system.
3.6 The internet user has the possibility to consult the offered touristic services, by inserting one or more parameters in the online booking system. The list of the individual business establishments is based on the inserted parameters and will be shown according to a casual rotation system and does not represent a valuation and/or classification of the service offered.
3.7 The internet user commits himself not to insert data in the online booking system which are in any way illegal, false, obscene or of pornographic content, which could harm the good name of The Tourism Consortium Alta Badia, which could harm in any possible way the rights of a third party, which are defamatory or data which are wrong and/or damage the functionality of the online booking system.
3.8 The internet user expressly declares that he has knowledge of all the rights regarding the inserted data and commits himself to maintaining the Tourism Consortium Alta Badia unharmed from whatever claim from third parties independently of the fact, be they brought on judicially or extra-judicially.
3.9 The client expressly declares of having payment authorization on his credit card or any other non monetary payment method as well as guaranteeing that the detracted sums be covered and/or that the individual credit cards are not blocked.
Art. 4 (Booking procedure)
4.1 The internet user may modify, correct and/or cancel the inserted data in the according boxes/spaces on the booking page up until the moment in which he confirms booking by clicking on the “book“ button. The user is therefore reminded to accurately check inserted data various times before confirmation.
4.2 PETS: The internet user needs to expressly agree direct with the establishment provider the hosting of pets and relevant conditions to such acceptance(any addi-tional cost) and to establish the terms and nature of such agreement between the two parties prior to arrival.
4.3 The data inserted by the internet user are received by the online booking system and considered as a booking after that the user has accepted the present general conditions and clicked on “book“.
4.4 The booking is confirmed once the clients data have been received by the online booking system, the client has received the email booking confirmation and the deposit has been deposited successfully. The Tourism Consortium AltaBadia does not take any responsibility for an extra confirmation, written or oral, sent by the individual business establishment.
4.5 Within 24 hours of booking the client will receive a mail generated automatically from the online booking system with which the booking is confirmed. A copy of this must be shown to the individual business establishment.
4.6 By sending the details of his credit card, the user expressly authorizes the Tourism Consortium to automatically debit 30% of the final price of the touristic services as a deposit.
4.7 The receptive business expressly authorizes the Tourism Consortium Alta Badia to cash the deposit of 30% from the total price of the client for the booked touristic services. The said sum will be immediately and automatically transferred to the individual business establishment onto a current bank account.
4.8 The remaining sum for the booked touristic services shall be paid directly on site by the client to the individual business establishment. The Tourism Consortium Alta Badia does not guarantee acceptance of credit cards or other payment methods on behalf of the individual business establishment .
4.9 Should the deposit not get sent, for any reason at all, there shall be no booking and no legal relationship.
Art.5 (Responsibilities of the Tourism Consortium Alta Badia)
5.1 The Tourism Consortium is not responsible for the accuracy and completeness of data accessed through the online booking system, or least of all for the actual availability of the touristic services offered or for the accuracy or completeness of the prices indicated by the individual business establishment.
5.2 The Tourism Consortium Alta Badia in any case whatsoever cannot be held responsible for a possible overbooking and least of all in cases of false or misleading offers.
5.3 The Tourism Consortium is not responsible for the quality of any of the touristic services offered.
5.4 The Tourism Consortium declines any responsibility regarding possible damage, of any kind, resulting from the unavailability, malfunctioning or interruption of the online booking system. In the same way the Tourism Consortium is not responsible for any damage caused by wrong bookings and/or damage caused by the illegal and abusive use of the online booking system by third parties.
Art.6 (Privacy Policy)
6.1 Within the meaning of Italian Legislative Decree 196/03 the Tourism Consortium Alta Badia informs that person data transmitted by the internet user shall be saved and elaborated for the purpose of administering the booking process.
6.2 The aforementioned data administering shall be executed in the full respect of existing criteria on treatment of personal data foreseen in art.4, paragraph 1, letter a) of the quoted decree for the purpose of guaranteeing the safety and secrecy of the mentioned data.
6.3 The client agrees to the use of given personal data for the purpose of market research, even by using automated instruments, as well as for the sending, also in a telematic way, of possible information, advertising and promotional material by the Tourism Consortium. The mentioned personal data may be given or passed along to third parties commissioned by the Tourism Consortium Alta Badia, in Italy and abroad (countries of the ECE), and used for the same purposes as already described in this article.
6.4 The individual business establishment, manifests its free consent in order that the Tourism Consortium Alta Badia proceeds to the treatment of its own data as seen in the present information document. Furthermore, it attests to be privy to its rights foreseen by art 7. Of the Italian Legislative Decree 196/03
Art.7 (Sole jurisdiction)
7.1 For whatever debatable cause which may arise regarding the interpretation and performance of the contract as well as the general conditions sole jurisdiction is exclusively granted to the Court of Bolzano, local section of Brunico, with expressed exclusion of other concurring courts.
